1. Acceptance of Terms

By accessing or using Saika ("the Service"), available at app.saikaboard.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised terms. We will notify registered users of material changes via email or an in-app notice.

2. User Accounts

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

  • You must be at least 16 years old to create an account.
  • You must provide accurate and complete information during registration.
  • You are responsible for notifying us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Content Ownership

You retain full ownership of all content you create, upload, or store on Saika, including but not limited to boards, cards, notes, images, files, and links ("Your Content").

By using the Service, you grant Saika a limited, non-exclusive license to host, store, display, and transmit Your Content solely for the purpose of operating and providing the Service to you and those you share it with. This license terminates when you delete Your Content or close your account.

Saika does not claim ownership over Your Content and will not use it for advertising, training, or any purpose other than delivering the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Upload or share content that infringes on the intellectual property rights of others.
  • Distribute malware, spam, or any harmful or malicious content.
  • Attempt to gain unauthorized access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Harass, abuse, or threaten other users.
  • Use the Service for any illegal, fraudulent, or deceptive purpose.

We reserve the right to remove content and suspend accounts that violate this policy, with or without prior notice.

5. Billing & Subscriptions

Saika offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Polar.

  • Subscription fees are charged at the start of each billing cycle. Prices are displayed in USD unless otherwise noted.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you will retain access until then.
  • We do not offer refunds for partial billing periods, except where required by applicable law.
  • We reserve the right to change pricing with at least 30 days' notice before the change takes effect for existing subscribers.

6. Service Availability & Changes

We strive to keep Saika available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue a material feature of a paid plan, we will provide reasonable notice and, where appropriate, a prorated refund or credit.

7. Termination

You may terminate your account at any time by contacting us or using the account deletion option in the Service. Upon termination, your data will be handled in accordance with our Privacy Policy.

We may terminate or suspend your account if you violate these terms, engage in abusive behavior, or if required by law. Where possible, we will provide notice and an opportunity to export your data before termination.

8. Limitation of Liability

To the maximum extent permitted by law, Saika and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of the Service.

Our total liability for any claim arising out of or relating to these terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.
